Explanation on the Misconceptions and our Recommendations to the Cybercrimes Bill Amendments in the Kenyan Digital Space

1,Introduction 
The Cybercrimes Bill, is not new in kenya it was signed to law during President Uhuru Kenyatta time( 2018), and have be challenged in court previously by organisations like the Bloggers Association of Kenya, Above is Don Raphael Njogu Mwangi ,The Gen Zs president secretariat opinion on the law to BAKE.

2,Explanation.

a, The Bill,  is under going amendment which are timely informed, to regulate social media and online abuse, that can promote Unlawful activities online this includes and not limited to Terrorism and False Information, we should further understand that anything allowed by our laws and the Kenyan constitution or international laws is not considered Unlawful, having the law in place is a big step to regulate the freedom of expression which can be easily abused online, the law will protect you from such acts and will be easy for prosecution of person if you feel offended and can prove crimes like defamation among others.

b, Technology, is the future and social media is part of the community, it should be regulated just like we have laws in our community to regulate how we socialise to avoid violations of others rights, like the common saying your rights ends where mine starts.

c,  To technology Enterprenuers, the bill will rise the Kenyan online community standards and trust, so that we can equally compete with other developed countries and improve our rankings in the digital space internationally.
 
d, The law will help in maintaining a healthy online use which has largely been dominated by misinformation like fake followers and logarithmics used to clout chase and brain wash online users.

3, Recommendations
a, To avoid misuse of the law,  our courts should only impose those Fines on guilty parties only , not the primitive court cash bills imposed to accused parties on such cases that are used to intimidate and abuse court processes this have depreciated our courts credibility to Kenyans, most of this crimes are largely Civil like defamation not criminal.

b, The government should take lessons from countries like China and regulate social media platforms, available to Kenyans through a one national social media dashboard regulation system, this will help control what our society consumes online, which can sometimes be dominated by misinformation.

C, The government, should also regulate our traditional media platforms in kenya with issuance of specialised TV broadcast licence to media platforms , this will grow our media platforms to levals of the United States and will help grow our creative industry with growth of stations dedicated to specific operations and professionalism, like we have  Mtv for music videos, Bet for black culture, CNN for  news, FOX for TV Shows , Super sports etc, this will help resolve the local current media experience that is a jack of all trades and can be of no mean full grow to our country creative industry grow and other professionalism if we are to achieve a 1st class level as our president is advocating for.
